This document constitutes the TERMS and CONDITIONS, which govern the use of the mobile application named WERCOS MEDIA (hereinafter “THE APPLICATION") and the related services offered by WERCOS ENTERTAINMENT, SOCIEDAD ANONIMA DE CAPITAL VARIABLE (hereinafter the "THE COMPANY "), with address located in Paseo de los Tamarindos 384, 9°-999, Colonia Campestre Palo Alto, Cuajimalpa de Morelos, Mexico City CP 05119, Mexico, also for their part, the users who download this APPLICATION, indicate their absolute acceptance of these TERMS AND CONDITIONS and the fact that they continue using THE APPLICATION will indicate that they agree with what is described in this document.

Users of THE APPLICATION are obliged to use it in accordance with these TERMS and CONDITIONS, in a lawful and diligent manner in accordance with morality and good customs.

FIRST. All content within THE APPLICATION, including but not limited to texts, images, photographs, logos, databases, as well as the graphic design and source code and software, are the exclusive property of THE COMPANY .

THE COMPANY owns all intellectual property rights related to THE APPLICATION, its use and the Services provided within it, therefore, no ownership rights are granted to the user when using THE APPLICATION, specifically but not limited to the creation and development of word search puzzles within THE APPLICATION. Likewise, it is understood that the words that comprise the various languages ​​that can be used within THE APPLICATION are in the public domain as they are not subject to registration in the Mexican Republic, misuse of THE APPLICATION by the user may result in a expulsion of the servers that provide its services, also does not generate legal liability of any kind for THE COMPANY.

The rights of the user in relation to the content they upload to THE APPLICATION, such as their name in the profile, profile photograph and/or any other content derived directly from the user, do not change. We do not claim ownership of the content you publish in relation to the aspects mentioned above and you can share it with whoever you deem appropriate wherever you consider appropriate. However, the user must grant us certain legal permissions (“license”) for us to provide the Service. When you share, publish or upload content protected by intellectual or industrial property rights (words or text) on or in connection with our Service, in accordance with this agreement, you grant us a worldwide, non-exclusive, transferable, sublicensable and royalty-free to host, use, distribute, modify, maintain, reproduce, translate and publicly display or communicate your content, as well as to create derivative works (in accordance with your privacy and application settings). The license will terminate when the content is removed from our systems.

The user has the option to delete their account within THE APPLICATION, at any time, but must send a request to the following email to the following address  webmaster@wercos.com in case they wish to delete the content created by them, so that it cannot be viewed or used by other users within THE APPLICATION, otherwise the user understands that the word searches created prior to deleting their account may remain within the digital library of THE APPLICATION and depending on the privacy selected by the user, these could be used by others.

You cannot publish private or confidential information of another person without their permission or take actions that violate the rights of third parties, including intellectual and industrial property rights (for example, infringements related to copyright or trademark, counterfeits, or pirated articles),  as well as racist, sexist, xenophobic, violent, vulgar or offensive content in general or in particular, towards any individual, group, belief, implicitly or explicitly.

You may use another person's work in accordance with the limitations or exceptions established in the legislation on copyright and other related rights, within the framework of the applicable regulations in México.

The User represent itself or have obtained all necessary rights in relation to the content you post or share.

Users of the APPLICATION should be aware that they can generate content within it that can be used not only within the same APPLICATION, but also through Internet links that redirect you to it.

Furthermore, THE COMPANY is not responsible in any way for the words or symbols or the way they are used, that may be used within the APPLICATION, in the understanding that the user is free to generate private or public content that can be viewed by other users or the public.

SECOND.

Use of THE APPLICATION.

• THE APPLICATION is intended for personal, non-commercial use only. You may not use THE APPLICATION for any illegal purpose or purpose not explicitly authorized by THE COMPANY.

• The user is responsible for maintaining the confidentiality of your login information and for all activities that occur under your account within THE APPLICATION.

THIRD.

Reproduction of content.

In relation to the source code and the elements strictly related to the programming and editing of THE APPLICATION, the use of all elements of said content that are found within it and that are the subject of intellectual and industrial property is strictly prohibited, so it is prohibited including its reproduction, copy, distribution, modification, alteration in whole or in part of said content.

Likewise, the use and/or reproduction of texts, words, or lists of words and topics related to word searches belonging to THE APPLICATION is prohibited, excluding from this category those created by each user and that are for public use.

FOURTH.

THE COMPANY  reserves the right, at its sole discretion, to interrupt, modify, alter the content and/or access of THE APPLICATION, at any time and without prior notice, whether for technical, security, control, maintenance, power failures or any other cause  including improper use of it.

THE COMPANY  will ensure that the information contained in THE APPLICATION is correct and updated at the time it is included in it. However, inadvertent errors or inaccuracies may occur.

THE COMPANY  will not be responsible for errors or omissions contained in its pages, Likewise, THE COMPANY is not responsible for any rude or explicit content,  as well as racist, sexist, xenophobic, violent, vulgar, or offensive content in general or in, towards any individual, group, belief, implicitly or explicitly. that the user may publish within it.  nor does it undertake to immediately update the information contained in its digital publications.

In the understanding that THE APPLICATION contains lists of restricted and prohibited words to promote the proper use of the app and in accordance with good customs, which is updated periodically, in accordance with THE COMPANY'S times, if the user creates a soup of letters that contain offensive, racist, sexist or offensive topics, words or content in general, the user will be solely responsible and THE APPLICATION and THE COMPANY are exempt from all liability.

Therefore, THE COMPANY  does not guarantee the usefulness, availability, and continuity of the operation of THE APPLICATION, as well as the products and services for carrying out any specific activity, or their infallibility.

For the convenience of the User, THE APPLICATION may provide links (hereinafter Links) to other third-party sites or Internet pages, whose content or information is not reviewed by THE COMPANY . Unless expressly stated otherwise, any page or site linked to our pages is independent of THE COMPANY , so THE COMPANY  has no control over such products, services, materials, or any other information contained in or available through the Pages. or sites of said third parties, nor will it be understood that THE COMPANY  recommends said products or services of third parties that have a Link to THE APPLICATION. Access to any Link is at the user's risk.

Some products and/or services made available to the user through THE APPLICATION may require keys or passwords to verify the user's identity. The user agrees that any operation correctly identified with said keys or passwords will be considered validly performed by the user. Therefore, the user will be solely responsible for maintaining the confidentiality of said keys or passwords, regardless of whether they were provided by THE COMPANY  or selected by the user.

FIFTH.

THE APPLICATION automatically collects information from browsers, mobile devices, and servers using THE APPLICATION. The information obtained will serve to provide the services of THE APPLICATION and will also contribute to the understanding and improvement of the services provided,  which includes advertising.

The information that is collected automatically includes the next items:

·         Usage information

·         Location information

·         Information from cookies and other similar technologies, to track online browsing habits.

The information collected will allow the user to process payments, and display advertising according to the interests of each user, derived from the information collected by THE APPLICATION.

A large part of our service involves creating and using cutting-edge technology to help us personalize, protect, and improve our service at scale, so that it can be made available to a wide community. To guarantee the functionality and integrity of the service, various technologies such as artificial intelligence and machine learning will be applied.

Regarding the possibility that the user uses the word search services within THE APPLICATION to upload Personal Data, THE COMPANY will not be responsible for the misuse that other users may make with said information, so the user is aware. of the risk involved in publishing sensitive data. Therefore, it is recommended to review the privacy of each word search that the user develops.

Notwithstanding the above, and given the nature of the Internet, THE COMPANY  does not guarantee that all use of THE APPLICATION or the products and/or services provided through it is free of risk, for which THE COMPANY  will not have responsibility. any, including damages, losses or any other that may be caused by third parties' misuse of the information generated, received, transmitted, or archived in THE APPLICATION.

THE COMPANY is excluded from any civil, criminal, administrative liability, or for direct or indirect damages, or any other caused or derived from: (i) The presence of viruses or other harmful elements in the products and/or services provided through of THE APPLICATION or by third parties that have a Link that may cause alterations in the computer system or electronic documents of the users; (ii) Errors or omissions contained in THE APPLICATION, or use of the information contained therein.

Any decision based on the information contained in THE APPLICATION will be the responsibility of the user; (iii) The use or inability to use the APP, products and/or services or any of its parts, or its Links, including any loss of programs or information; (iv) The knowledge that unauthorized third parties may have of the type, conditions, characteristics and circumstances of the use that users make of THE APPLICATION, the products and/or services; (v) Access to THE APPLICATION or the use of information or applications contained therein that generate damage to the user's software or hardware; (vi) The misuse by third parties of the information generated, received, transmitted, or archived in THE APPLICATION. (vii) The lack of availability or continuity of the operation of THE APPLICATION, the products and/or services, the non-usefulness that users may have attributed to THE APPLICATION, the products and/or services, and the fallibility of the LA APPLICATION, of the products and/or services.

The modification in our services, policies and/or TERMS and CONDITIONS may be modified at any time without any notification, it will only be necessary to publish the changes in THE APPLICATION. The use of the platform or consultation of the services after this date will imply acceptance of the modifications made. If you do not agree to these TERMS and CONDITIONS, you may not access or use the APP in any other way.

The use of THE APPLICATION is subject, in addition to the TERMS and CONDITIONS described here, to all notices, regulations of use and instructions, which are made known to the user by THE COMPANY  or through any means, whether electronic or physical.

This document is directly related to the applicable legislation within the Mexican Republic and should not be confused or superimposed on various national legislations.
